Dear Mr. Netkin:

Thank you for your letter dated October 29 to Stephen Cunliffe, and for explaining your concerns.  Nestle has issued a response regarding the video, and I can share with you this statement:
The man appearing on the video is an independent contractor, not a Nestle employee.
Nestle is no longer doing business with this individual or his company.
Like you, we were appalled at the behavior of the contractor. The man in no way represents Nestle views or policies. As an outside contractor, he had a temporary contractor badge at the time he was filmed.
Nestle follows all laws regarding documentation of our workers. We only employ those who have the right to legally work in the US.
Will you be able to post this statement on your site?

Thank you.

In Response to Watchdog America's posting on October 29, 2006, Loretta Ivany of Nestlé USA, sent the following letter.
Comments by Hal Netkin to Loretta Ivany.

In my letter of October 29 to Stephen Cunliffe, two of the following three demands were not satisfied.

1. The offending contractor be fired at once.
OK: Nestle is no longer doing business with this individual or his company.

2. A promise by Nestle to take measures to prevent the future hiring of unauthorized workers.
No mention was made to take measures against a repeat of the incident.

3. A public apology.
No public apology was made.

Ivany claims that Nestle follows all laws regarding documentation of our workers. That was not in dispute. Apparently, however, Nestle does not follow the law regarding who their contractors hire. Walmart paid an $11 million fine because their CONTRACTOR used illegal labor.

Having said the above, I am convinced after speaking with Ms. Ivany by telephone, that Nestles will not repeat the hiring of contractors who will hire illegal aliens.
